Verification of Licences

Summary:
Application for a Certificate of Validation
Detail:
The Bermuda Department of Civil Aviation is implementing a system whereby all applicants for an initial Certificate of Validation (CV) are required to have their licence verified by the Contracting State that issued the said licence.
It will be the responsibility of the applicant to initiate this process and failure to do so could lead to delays in the subsequent issue of the CV. In any circumstance please be advised that it can take up to 30 working days to issue a Certificate of Validation.
This process will become mandatory from the 1st January 2009.

F.A.A. Temporary Certificates

Summary:
The Bermuda Department of Civil Aviation will no longer issue a Certificates of Validation of a Flight Crew Licence which is supported by a F.A.A. Temporary Certificate granted prior to an Initial issue of a full Certificate.
Detail:
It has come to the notice of the Bermuda Department of Civil Aviation that Temporary Airmen Certificates issued by the F.A.A. do not guarantee that a full Certificate will be granted by the F.A.A. We have been advised that these Certificates are not acceptable for International Operations in accordance with the Articles specified by I.C.A.O.
Temporary Airmen Certificates issued when additions or changes are being made to an existing Certificate are still acceptable to the Bermuda DCA.
F.A.A. Second in Command (SIC)

Summary:
The Bermuda Department of Civil Aviation will not issue a Certificate of Validation based on a F.A.A. second in command endorsement on a F.A.A. Airman’s Certificate.
Detail:
The Bermuda Department of Civil Aviation requires all applicants for Certificates of Validation to have completed a Pilot in Command proficiency check on the aircraft type(s) for which a validation is requested.
GENERAL EXEMPTION

Summary:
AN(OT)O 2007 Article 11 - Technical Log for non-CAT aircraft.
Detail:
The Director of the Bermuda Department of Civil Aviation, being designated by the Governor under Article 153 of the Air Navigation (Overseas Territories) Order 2007 (the Order), in exercise of the Governor's powers under Article 146 of the order hereby exempts the operator or lessee, as appropriate, of an aircraft registered in Bermuda from complying with Article 11(1)(a) and (2) of the Order insofar as it requires a technical log to be kept for an aircraft not operated for the purpose of commercial air transport.
This exemption is valid until 30th June 2009 unless previously suspended or revoked either generally or in relation to a specific case.

Detail:
The Director of the Bermuda Department of Civil Aviation, being designated by the Governor under Article 153 of the Air Navigation (Overseas Territories) Order 2007 (the Order), in exercise of the Governor's powers under Article 146 of the Order hereby exempts the operator or lessee, as appropriate, of an aircraft registered in Bermuda not operated for the purpose of commercial air transport and in respect of which a certificate of airworthiness is in force from complying with Article 10(1)(a) of the Order insofar as it requires a maintenance control manual or equivalent document approved by the Governor in relation to that aircraft.
This exemption is valid until 30th June 2009 unless previously suspended or revoked either generally or in relation to a specific case.

AN(OT)O 2007 - Article 10(1)(a) - Approved Maintenance Programme
Detail:
The Director of the Bermuda Department of Civil Aviation, being designated by the Governor under Article 153 of the Air Navigation (Overseas Territories) Order 2007 (the Order), in exercise of the Governor's powers under Article 146 of the Order hereby exempts the operator or lessee, as appropriate, of an aircraft registered in Bermuda and in respect of which a certificate of airworthiness is in force from complying with Article 10(1)(a) of the Order insofar as it requires a maintenance programme approved by the Governor in relation to that aircraft.
This exemption is subject to there being an applicable maintenance schedule approved by the Governor in relation to that aircraft.
This exemption is valid until 30th June 2009 unless previously suspended or revoked either generally or in relation to a specific case.

Detail:
The Director of the Bermuda Department of Civil Aviation, being designated by the Governor under Article 153 of the Air Navigation (Overseas Territories) Order 2007 (the Order), in exercise of the Governor's powers under Article 146 of the Order, hereby exempts the operator or lessee, as appropriate, of an aircraft registered in Bermuda not operated for the purpose of commercial air transport and in respect of which a certificate of airworthiness is in force from complying with Article 10(1)(a) of the Order insofar as it requires the arrangements for continued airworthiness management of such an aircraft to be approved by the Governor.
This exemption is valid until 30th June 2009 unless previously suspended or revoked either generally or in relation to a specific case.

GENERAL EXEMPTION

Exemption to General Aviation for the Requirement for Approval.
Detail:
The Director of the Bermuda Department of Civil Aviation, being designated by the Governor under Article 153 of the Air Navigation (Overseas Territories) Order 2007 (the Order), in exercise of the Governor's powers under Article 146 of the Order hereby exempts operators subject to Article 83 of the Order and whose aircraft are registered in Bermuda from holding an approval required under Article 84 of the Order.
This exemption is valid until 30th June 2009 unless previously suspended or revoked either generally or in relation to a specific case.

GENERAL EXEMPTION

Summary:
Schedules 4 and 5 of the AN(OT)O 2007
Detail:
The Director of the Bermuda Department of Civil Aviation, being designated by the Governor under Article 153 of the Air Navigation (Overseas Territories) Order 2007 (the Order), in exercise of the Governor's powers under Article 146 of the Order hereby exempts operators of aircraft registered in Bermuda from complying with Aricles 15 and 16 of the Order insofar as those Articles require the operator to fit in such aircraft the equipment specified in Schedule 4 [or Schedule 5] of the Order [respectively], subject to the following conditions:
1) The aircraft is operated in accordance with the requirements contained in Overseas Territories Aviation Requirements:
Part 91; or
Parts 119 and 121; or
Parts 119 and 135; or
Part 125
as appropriate to the type of operation in which the operator engages as specified in those Parts.
2) Where required under the Order, unless otherwise exempted, the operator holds a valid approval appropriate to the type of operation in which the operator engages as specified in those Parts of the Overseas Territories Aviation Requirements referred to in condition 1).
This exemption is valid until 30th June 2009 unless previously suspended or revoked either generally or in relation to a specific case.
