Protection of the Public Interest and Restictions on use of Aircraft
6.1.1 - The Director is responsible for ensuring that aircraft registered in Bermuda are not used for purposes other than those for which they have been certificated and that the public interest in that regard is protected.
6.1.2 - Aircraft shall be operated and maintained at all times in accordance with the certificates and approvals issued by the Director and in compliance with the Order. Aircraft must be operated strictly in accordance with the requirements of the airworthiness category for which they have been certificated. In particular, operation of aircraft for financial consideration for the carriage of passengers or cargo constitutes 'public transport' and may not be undertaken by aircraft certificated in the Private Category. In such cases, the aircraft must be certificated in the Public Transport Category and the operator must be the holder of an AOC. It is important that the intended use of the aircraft be clearly stated at the time of initial preliminary application (see paragraph 3.4.2).
