Introduction
1.1 - Applications to register aircraft in Bermuda shall be approved by the Director of Civil Aviation (the Director) and this brief provides general information for applicants intending to make such applications to the Bermuda Department of Civil Aviation (the Department).
1.2 - Aircraft may be registered and certificated for private use and issued with a Private Category Certificate of Airworthiness (C of A). Aircraft intended to be used commercially may be issued with a Transport or Aerial Work Category C of A. Transport Category certificates may be issued for the carriage of passengers or cargo or both.
1.3 - Transport Category aircraft may be operated in accordance with a Bermuda Air Operators' Certificate (AOC) or in accordance with an AOC issued by another State to an airline in that State, the latter under an agreement between Bermuda and the other State.
1.4 - Further information concerning the operation of Bermuda registered aircraft by an airline in another State can be obtained from the DCA.
1.5 - It is important that prospective applicants for Bermuda registration of aircraft seek legal advice before proceeding with any application. Prospective applicants may seek further information from the Department but shall make the actual application for registration via one of several Bermuda law firms that specialise in the registration of aircraft in Bermuda. There are several reasons for this course of action including the determination that an applicant is a qualified person eligible to own a Bermuda registered aircraft.
1.6 - A list of Bermuda law firms that specialise in registering aircraft in Bermuda, and other useful general information such as application forms concerning Bermuda certification of aircraft, may be found on the Department's website at www.dca.gov.bm. The website contains details of all Department personnel, their respective responsibilities and their contact details.
1.7 - Once an Exempted Company has been established using the services of an appropriate Bermuda law firm, various tax and operational benefits become available to that company including the facility to register aircraft in Bermuda.
1.8 - The Department is able to provide advice concerning aircraft registration and operating benefits. However advice concerning taxation and other financial benefits should be sought from Bermuda law firms qualified to provide this information.
1.9 - The Register functions in association with a range of services provided by Bermuda to international business. Aircraft registered in Bermuda enjoy global acceptance and respect for their high standard of safety and their safe operation. The Director ensures that Bermuda registered aircraft are maintained and operated to the highest standards required and accepted internationally by reputable aviation regulatory authorities. On going safety oversight of all aircraft registered in Bermuda is carried out by Department inspectors located in Bermuda and around the world. Inspections are conducted in accordance with international regulatory standards to ensure that aircraft owners' and operators' interests are protected.
1.10 - The Director welcomes all enquiries concerning the registration of aircraft in Bermuda and their subsequent operation. Every assistance will be provided to the enquirer with the procedures to be followed to achieve aircraft registration and certification. It is the Department's policy to be responsive to requests and applications and to process these expeditiously.
