5.2 - Advantages of Registering Aircraft in Bermuda

5.2.1 - Bermuda has been classified as a Category 1 jurisdiction by the FAA under their International Aviation Safety Assessment Program (IASA). This provides confidence for intending registrants of Private Category aircraft that their aircraft, a valuable asset, will benefit from a continuing high standard of safety oversight during the time the aircraft is registered in Bermuda.

5.2.2 - Category 1 classification by the FAA further provides confidence to owners and operators of aircraft registered in Bermuda, and operated commercially in accordance with a foreign AOC, that their aircraft will benefit from a high standard of safety oversight during the leasing period.

5.2.3 - Aircraft may be registered in Bermuda, under a suitable agreement, and may be commercially operated by an airline in another State. This is particularly attractive to aircraft owners and leasing companies that have found customers in countries where they are reluctant to register their asset because of legal or financial uncertainty or political unrest.

5.2.4 - An aircraft operator may qualify for the issue of a Bermuda AOC to carry out commercial aircraft operations. One of the qualifications for the issue of the AOC is that the principal place of operation shall be in Bermuda. Principal place of operation means that the controlling management of the aviation enterprise will be based in Bermuda.

5.2.5 - In addition to the considerable tax advantages referred to in 3.3.4 of this brief and further that Bermuda does not normally require an import licence and does not charge importation tax upon aircraft, owners and operators of aircraft will find BDCA personnel to be helpful, responsive and quick to solve difficulties that may be encountered. These qualities are not always available with the aviation regulators of other countries. The Director is able to accept aircraft for registration in Bermuda having Type Certificates issued by the FAA, EASA or Transport Canada. Once registered, it is required that an aircraft will thereafter remain in compliance with documentation required by the Type Certificate accepted; for example the Flight Manual, the MMEL, the MPD, airworthiness directives etc, required by the State of issuance of the Type Certificate. It may be seen that this facility enables an aircraft to join the Register from another register with minimum inconvenience, and if later sold, be exported back to the original jurisdiction with minimum difficulty.

5.2.6 - The Director is able to issue Bermuda validations for pilot licences issued by the aviation authorities of a number of countries where the standard for issuance has been found to be acceptable. Information concerning this may be obtained from the BDCA Flight Operations Inspector.5.2.7 - Bermuda has available the full range of legal and financial services that are necessary to ensure that all requirements associated with the financing, mortgaging and registration of aircraft can be accomplished with minimum delay and inconvenience.
