3.4 - Application to Register an Aircraft

3.4.1 - The Director examines individual applications for aircraft registration to determine their acceptability and appropriateness with regard to Bermuda statute and Government policy. He will also take all steps necessary to ensure that an attempt is not being made by an applicant to use the Register to circumvent the standards of aircraft operation detailed in the Annexes to the Convention on International Civil Aviation.

3.4.2 - It is therefore important that prior to proceeding with the incorporation of an Exempted Company prospective applicants make preliminary written application to an appropriate Bermuda law firm stating the use to which the aircraft will be put and briefly setting out the following details:

  1. the name under which the aircraft is to be registered;
  2. the name and nationality of the individual person enjoying ultimate ownership and control, the beneficial owner;
  3. particulars of the aircraft, including correct designation, constructor's serial number and year of manufacture;
  4. the place where the aircraft is based and main geographic areas of operation;
  5. the proposed aircraft maintenance provider;
  6. the proposed operations and crewing arrangements;
  7. any additional facts which may be helpful in enabling a determination to be made as to whether it is appropriate to entertain a full aircraft registration application.

Having applied due diligence and obtained satisfaction concerning the eligibility of the applicant, the Bermuda law firm will make application to the Director for Approval in Principle for the aircraft to be registered, using BDCA Form 100. All information furnished in this preliminary application will be treated with strictest confidence and will not form part of the public record of a subsequent registration.

3.4.3 - If the Director determines that aircraft registration may proceed, confirmation will be provided to the Bermuda law firm so that formal application may be made. This is undertaken in the form that the Director may, from time to time, require and is to be supported by such documents and evidence as are necessary, relating to the aircraft, the ownership and chartering to enable a final decision on registration to be made.

3.4.4 - At the time of registration, the Bermuda Department of Telecommunications may issue a radio station operating licence to an aircraft. This is called a 'Class Six Radio Operating Licence' and registrants should have made prior application to the Department of Telecommunications for this during the registration process. Bermuda law firms usually undertake this process upon a request being made to them by the applicant.

3.4.5 - The Government of Bermuda does not require persons registering aircraft in Bermuda to obtain Import Licenses and no other consents are required in respect of registration from any other official bodies. An exception to this may arise in the event of an aircraft being physically imported to the Island for use domestically in Bermuda. Such aircraft may be subject to Customs duty and other possible requirements. Depending upon its intended use, it may also be subject to restrictions arising from other Government bodies. Persons proposing to undertake the importation of an aircraft for use within Bermuda are advised to consult their law firm in advance of importing an aircraft.
