3.2 - Aircraft that may be Registered in Bermuda

3.2.1 - The requirements in respect of registration are detailed in Article 4 of the Order and access to the Order can be obtained on the Department's web site.

3.2.2 - The Order provides that an aircraft shall not be registered or continue to be registered in Bermuda if it appears that:

  1. the aircraft is registered outside Bermuda and that such registration does not cease by operation of law upon the aircraft being registered in Bermuda; or
  2. an unqualified person holds a legal or beneficial interest by way of ownership in the aircraft or any share therein; or
  3. the aircraft could more suitably be registered in some other part of the Commonwealth; or
  4. it would be inexpedient in the public interest for the aircraft to be or to continue to be registered in Bermuda.

3.2.4 - An unqualified person holding a legal or beneficial interest by way of ownership in an aircraft or a share in it may still obtain registration if he resides or has a place of business in Bermuda and the Governor is satisfied that an aircraft may properly be registered.

3.2.5 - Similarly, if an aircraft is chartered by demise to a qualified person, the Governor may permit registration in the name of the charterer during the period of the charter, whether or not an unqualified person is entitled as owner to a legal or beneficial interest in the aircraft or a share in it. Both of these exemptions are subject to the discretion of the Governor and the full facts and circumstances must be presented to the Director before registration will be considered. It may be expected that, provided the application may otherwise be properly accepted, such approval will not be unreasonably withheld. An aircraft so registered may not be used for the purpose of public transport or aerial work. It may be seen from paragraph 3.2.3 above that included in the list of 'qualified persons' are bodies incorporated in some part of the Commonwealth and having their principal place of business in any part of the Commonwealth. It should be noted that, by Bermuda Government policy, an application to register an aircraft is normally only accepted from a person residing in Bermuda or a body incorporated in Bermuda and having its registered office on the Island.
